Some Offenders Are Eligible For A Pretrial Intervention/Diversion Program

In December 2013, the McLennan County District Attorney’s Office started an official “pretrial intervention program.” Please ask us about this fairly new program in McLennan County!

Typically, a pretrial intervention or pretrial diversion program is something I refer to in our office as a “desk drawer probation.” This program may allow you to avoid court disposition altogether, with the opportunity to try to resolve your case by complying with certain terms set out in a written agreement between you and the D.A.’s office. Depending on the case, those terms MAY sometimes include some of the following: community service hours, abstaining from alcohol, drug testing, electronic monitoring, classes and a program fee. If the terms are completed within the required time frame and you do not violate the agreement, then a pretrial intervention program typically allows for the dismissal of your case.

Particularly for young students who have no previous criminal history, this is sometimes a good option.
