Texas charges dismissed over failed identification of drugs

A man driving a truck full of plant material was recently arrested on suspicion of carrying more than 3,000 pounds of marijuana. The 39-year-old faced federal charges based on the size of the haul and the supposed attempt to distribute a narcotic. But that was never the case.

Hemp is the plant that produces marijuana, or at least the flower that contains a sizable amount of tetrahydrocannabinol, better known as THC. Most states have taken the step to legalize hemp, which is used in the manufacture of rope, clothing and protein supplements.

Texas defines hemp as the plant material containing less than .3% of THC. A federal crime lab tested the material in the suspect's truck and verified it was indeed hemp. He was released from jail and his charges were dropped, while his cargo is expected to be returned.

This is not the first time that police have made this mistake. Texas is among several states looking to improve law enforcement officers' ability to recognize hemp as opposed to illegal drugs.
