While Stephen Paddock may have wielded the weapons, others may be liable as well. The question becomes whether the event was foreseeable and therefore preventable. The behavior of Stephen Paddock during his stay at the Mandalay Bay should have raised red flags including bringing at least 10 suitcases, holding over 23 guns, into his hotel room. He set up cameras outside of his hotel room and kept a "do not disturb" sign on his door throughout the time he was in the hotel from September 25 through the shooting on October 1.

The concert host, Live Nation, may be liable based on lack of adequate design for exits in case of emergency, failing to train and supervise employees in case of emergency. The lack of an emergency plan may have cost victims.

There may also be a claim against Slide Fire Solutions, LP, which is the manufacturer of the bump stock used to transform the semi-automatic rifles into fully automatic rifles. If Stephen Paddock had not had this option for transforming his weapon, he would not have been able to fire as many rounds into the crowd, thus injuring and killing more people.
